Performing the obligations resulting from the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “Directive”), we inform of the following:

Processing purposes
Your personal data are processed in line with the Regulation for the purpose of:
a) research on the service quality, as well as for analytical and statistical purposes constituting the Controller’s legitimate interest (Article 6(1)(f) of the Regulation).
b) receiving trade information, marketing offers, including information on discounts and special offers sent to the provided e-mail address, pursuant to Article 6(1)(f) of the Regulation, if a relevant consent was given;
c) handling e-mail correspondence sent through the contact form, which constitutes the pursuance of the legitimate interest of the Controller or third parties (Article 6(1)(f) of the Regulation);
d) using Cookies, referred to in Cookies Policy, which constitutes the legitimate interest of the Controller or third parties (Article 6(1)(f) of the Regulation);
e) pursuing legitimate interest of the Controller or third parties other than mentioned above, i.e., among others, determining, pursuing and defending claims that may arise in connection with using the website (pursuant to Article 6(1)(f) of the Regulation).

Processing period
Your personal data shall be stored for a period necessary to fulfil the above-mentioned processing purposes. After the lapse of this period, they shall be stored for the limitation period of claims that may arise in connection with them. If the consent for the processing is given, the data shall be processed for a period necessary to fulfil the purpose of data processing, however not longer than until the withdrawal of the consent. The consent may be withdrawn at any time, without influencing the legitimacy of the processing carried out on the basis of the consent prior to its withdrawal. After the above-mentioned period, the data may be stored until the limitation of claims that may arise in connection with using the website.

Rights of data subject
At any time, you have the right to withdraw the consent for the processing of personal data (if such a consent was given), access, rectify, erase and restrict the processing of those data, move the data to another controller, object to the decision based only on the processing by automated means, including profiling, and the right to object to data processing, without influencing the legitimacy of the processing carried out on the basis of the consent prior to its withdrawal.

You have the right to lodge a complaint with the President of the Personal Data Protection Office, a supervisory authority dealing with personal data protection, if you believe that the processing of data by the Controller infringes the Regulation.

Details of personal data recipients
The Controller provides your personal data only to the entities providing services connected with the above-mentioned purposes to the Controller, i.e., among others, IT system suppliers, entities dealing with technical preparation, entities belonging to the TelForceOne S.A. Capital Group and third parties performing tasks connected with trade and marketing processes. Furthermore, your personal data may be made available to relevant public authorities, if it is required by virtue of the applicable law.

Obligation to provide data and consequences of failure to do so
In the case of providing data under a consent, you provide your data voluntarily, however failure to provide those data may prevent you from using selected options of the website.

In other cases, collecting data is necessary to fulfil the purposes of their processing. Failure to provide them could prevent the pursuance of legitimate interest of the Controller or third parties.

Data collected automatically
The website operating in the https://mydevia.pl/ domain uses the following tools:

Google Analytics – it is used to monitor and analyse traffic on the website. During your visit on the website, such data as: web browser type, operating system type, etc. shall be collected. The website also uses Google Analytics interest reports and demographic data.

Google Ads – it is used to run online campaigns in the search and advertising networks; it employs the mechanisms of targeting and remarketing of advertising messages. The website’s user may resign from Google Ads service for display advertisements and adjust the advertisements in the Google advertising network through advertisement Options. Data coming from Google based on the interests or data of external entities (e.g. age, gender and interests) are used to adjust the advertising messages better.

2. Cookies – IT data, in particular small text files, saved and stored on devices, through which the User uses the Website.
2a. Administrator’s Cookies – Cookies placed by the Administrator, connected with the provision of electronic services by the Administrator through the Website.
2b. External Cookies – Cookies placed by the Administrator’s partners through the Website.
3. Website – the Administrator’s website or application operating in the https://mydevia.pl/ domain.
4. Device – electronic device through which the User gains access to the Website.
5. User – entity to which, in line with the Regulations and law, electronic services may be provided or with whom a Contract for the Provision of Electronic Services may be concluded.

Cookies used by the Administrator are safe for the User’s Device. In particular, it is not possible for viruses or other unwanted software or malware to enter the Users’ Devices through Cookies. Those files allow for the identification of software used by the User and individual adjustment of the Website to each User. Cookies usually contain the name of domain from which they come, period for which they are stored on the Device, as well as assigned value.

The Administraotr uses two types of cookies:
Session cookies: they are stored on the User’s Device and remain there until a session of a given web browser is ended. Saved information is then permanently deleted from the Device’s memory. The mechanism of session cookies does not allow for downloading any personal data nor any confidential information from the User’s Device.

Persistent cookies: they are stored on the User’s Device and remain there until they are deleted. Ending a session of a given web browser or turning off the Device does not result in their deletion from the User’s Device. The mechanism of persistent cookies does not allow for downloading any personal data nor any confidential information from the User’s Device.

The User may restrict or turn off the access of cookies to their Device by changing the settings of their web browser. In such a case, using the Website shall be possible, except for the functions which require cookies due to their character.

Purposes for which Cookies are used
